According to the Insurance Information Institute, Tennessee is in the top 10 states with the highest rates of uninsured motorists. This study explained that 20.1 percent of drivers in the state do not have the insurance policies that are required by law. The LII explains that 21 states have requirements that drivers' insurance policies include coverage for uninsured motorists, underinsured motorists, or both. Tennessee, however, is not included in these states. It merely requires that drivers must hold bodily injury liability and physical damage insurance.

The high number of uninsured motorists, combined with a lack of required uninsured motorist insurance, is often detrimental to insured Tennessee residents. Those who are in accidents caused by uninsured accidents may not be able to collect any compensation. In cases such as these, the burden of any expenses incurred by the collision will be shouldered by the insured driver.

The unfairness of such situations can be addressed through the civil litigation process. If, however, the uninsured driver does not have the assets necessary to address these damages, the effort may not result in compensation for the victim.
